Do we have Constitutional Rights or Individual Rights?

The answer is Individual Rights. The U.S. Constitution does not grant us our rights. We are born with them and they are inalienable (incapable of being alienated, surrendered, or transferred{Webster}). Amendment nine(of the U.S. Constitution) - "The enumeration in the Constitution, of certain rights, shall not be construed to deny or disparage others retained by the people". This means that our rights are not limited to those listed in the Constitution. Therefore, if our rights go beyond what is listed in the Constitution they have to be individual and not constitutional. Now, with rights comes responsibility. If one infringes upon someone Else's Individual Rights they must pay just punishment. Also if one proves they cannot handle the responsibility of a certain right then it must be suspended for the safety of the people and their Individual Rights. To ensure this peace amongst the people is a responsibility of government granted to it by the people.
